1st Ward: El-Amin's $100,000 Fine; MEC v. Tyus

Oct. 2, 2008, MEC approved a Consent Order for Cases 07A055, 07A056 against Yaphett El-Amin, El-Amin for Senate, Committee to Elect Yaphett El-Amin for State Rep. El-Amin is 1st Ward Committeewoman, former candidate for 4th Dist. State Senator, former 57th Dist. State Rep., wife of current 57th Dist. State Rep. and 1st Ward Committeeman Talibdin El-Amin.

She was ordered to pay $50,000 on each case or within 90 days pay $5000 on each case, become fully compliant within 90 days, and commit no further violations. Violations included failure to properly form a committee and failure to properly terminate a committee (Section 130.021.2, 130.021.8), exceeding cash expenditure limits and failure to properly identify contributors or persons paid money (Sections 130.031.2, 130.031.3), failure to properlyreport receipts and expenditures (Section 130.041.1(3) and 130.041.1(4)), failure to file timely reports (Section 130.046.7).

1st Ward Alderman Charles Quincy Troupe doesn't appear concerned about his primary opponent, Sharon Tyus. Troupe's committee filed Limited Activity for the 40 Days Out Report. He last reported activity in April 2008. Tyus didn't form a committee until Jan. 26th, so her first report won't be due until 8 Days Out.

It could be Troupe is laying low report-wise and come 8 Days Out is when the money will show up. Or, maybe he doesn't think Tyus is a threat because she owes MEC.

Tyus was treasurer for the 20th Ward Regular Democratic Organization while she was 20th Ward Alderma and Sterling Miller, her husband, was 20th Ward Committeeman. Under the City's 2001 redistricting plan, the 20th Ward moved south to the 10th Ward, the 10th Ward moved west to The Hill, with Tyus and Miller ending up in the newly drawn 1st Ward.

Oct. 30, 2002, the organization's Jan., April, July, Oct. reports for 2001and 2002 were hand-delivered to MEC. Tyus filed a timely 2003 Jan. report and May 22, 2003, MEC closed a case (A1143) against Tyus.

She didn't submit an April or July report, failing MEC's standards in no more requirement. Sept. 15, 2003, MEC v. Sharon Tyus (22032-10134) was filed in St. Louis City Circuit Court. MEC never did receive the missing 2003 reports. But from Oct. 2003 to July 2006, when the committee terminated, Tyus turned in the paperwork on time.

March 11, 2004, MEC closed a case (A3161) against Tyus. Four days later MEC v. Sharon Tyus (22032-10134) was tried in St. Louis City Circuit Court. MEC received a judgment of $4,000 against Tyus. There is no record at Case.net that it was paid.

Sept. 24, 2004, MEC v. Sharon Tyus (22044-02249) was filed in St. Louis City Circuit Court. Jan. 19, 2005, the case was dismissed without prejudice after failed attempts to serve her a summons.

Nov. 8, 2006, MEC v. Tyus (06AC-AC01509) was filed in Cole County Circuit Court. April 23, 2007, the case was dismissed without prejudice after failed attempts to serve her a summons.

June 28, 2007, MEC v. Sharon Tyus (07AC-AC01063) was filed in Cole County Circuit Court. Oct. 22, 2007, the case was dismissed without prejudice after failed attempts to serve her a summons.

Dec. 13, 2007, MEC v. Sharon Tyus (07AC-AC02235) was filed in Cole County Circuit Court. May 19, 2008, the case was dismissed without prejudice after failed attempts to serve her a summons.

While Tyus was treasurer of the ward organization, she also had her own campaign committee, Citizens to Elect Tyus (which appears to have had no difficulty filing reports), and was treasurer for Citizens to Elect Norma Leggette (Independent, 4th Ward Alderman), for which MEC did not get an organizing statement until ten days before the election. Under Missouri law, a candidate cannot control more than one committee at a time.

Also in the 1st Ward, State Rep. Talibdin El-Amin amended his 30 Days After General Election Report, covering Nov. 5 to Dec. 5, 2008: $2250 raised, $4366.02 spent, $7,867.19 on hand, $6,926.56 debt. He raised $90,723 and spent $76,105.28 in the last election cycle.

On the Explanation page of the amended report is the statement, "correct entries inadvertently placed in wrong areas". That's peculiar language given his original filing was Limited Activity with zeros in every column.

Among the donors was $1000 from BizPAC (Greater KC Chamber of Commerce & Civic Council). Expenses included $450 to Boss Br. Cleaning, Florissant. Boss Brothers Complete Cleaning Service was a fictitious name registration by El-Amin and Larry Bastain, his brother, on 8-04-2003, canceled 3-26-04, and same day Bastain registered Boss Bros. Complete Cleaning LLC. Bastain is treasurer for Mrs. El-Amin's senate committee and Bastain's wife is treasurer for Mr. El-Amin's state rep. committee. The address used by the Bastains is located in the 18th Ward and owned by Alderman Troupe, according to City records.
