Charter Reform debate tomorrow night

Comptroller Darlene Green will participate in a panel discussion on city charter amendments A,B,C,D Wed., Sept. 29, 2004 at 7:00 p.m. in the New City School auditorium at 5209 Waterman Blvd. in St. Louis.

We reported in our last issue a rumor making the rounds that he would join the mayor in supporting A,B,and C. Wrong. He's against them all.

Political scientists, journalists to discuss upcoming elections

4th ward committeeman race nullified

Circuit Judge Dowd's ruling:

"The irregularities complained of did occur and were of such sufficient magnitude as to cast doubt on the validity of the election... [The] election for the office of Democractic Committeeman of the Fourth Ward of the City of Saint Louis [is] hereby declared null and void."

A new election is scheduled for the November ballot.

Petition for Declaratory Judgment

Comes Now Plaintiff Marti Frumhoff (hereinafter Frumhoff), by and through counsel, and for her Petition for Declaratory Judgment against Defendants Missouri Department of Natural Resources and Missouri Department of Economic Development (hereinafter "DED" and "DNR"), states as follows: 1. Frumhoff is, and at all times relevant herein was, a resident of the State of Missouri and St. Louis City County. Frumhoff is a taxpayer of the State of Missouri.
2. Defendants DED and DNR, at all times relevant herein, were duly organized and existing under the laws of the State of Missouri, with its offices in Jefferson City, Missouri within Cole County.
3. The Missouri Development Finance Board ("MDFB") is a governmental, non-profit entity created as a corporate body and politic by the State of Missouri.
4. The Project at issue here involves the proposed renovation of the St. Louis Custom House and Post Office (the "Old Post Office"). The Project involves the United States General Services Administration ("GSA") transferring title to the Old Post Office to the MDFB. The Land Clearance for Redevelopment Authority of the City of St. Louis ("LCRA") sold the Century Building, located across the street to the west of the Old Post Office, to the MDFB. The plan calls for the MDFB to own and develop, with NSG Developers LLC, the proposed Ninth Street Garage on the site of the Century Building once it is demolished. The MDFB will own but lease back to the St. Louis' U.S. Custom House and Old Post Office Building Associates, L.P. the Old Post Office in a 99 year long-term master lease.
5. The MDFB will take title of the Old Post Office on or about September 21, 2004.
6. The MDFB will lease the Old Post Office to a Developer for 99 years. The Developer is a partnership formed by the principals of The DESCO Group Inc. and DFC Group Inc., Mark J. Schnuck and Steven J. Stogel, through the legal entities of the NSG Developers LLC, Orion 2002, LLC, the Old Post Office Developers, LLC, and the St. Louis' U.S. Custom House and Old Post Office Building Associates, L.P. (hereinafter referred to as "Developer").
7. The funding of the proposed Old Post Office renovation comes from several sources, one of which is the Missouri state historic tax credit. (See § 253.545 to § 253.559, RSMo.).
8. The Missouri state historic tax credit enabling statute requires the state historic preservation officer of the DNR to determine, among other things, whether the rehabilitation meets the standards of the Secretary of the United States Department of the Interior. The issuing of certificates of eligible credits to taxpayers shall be performed by the DED. (§ 253.559, RSMo.).
9. A real and subsisting controversy exists between the parties hereto concerning whether the issuance of Missouri state historic tax credits to the Project is lawful.
10. Plaintiff has no adequate alternative remedy.

11. Plaintiff incorporates by reference Paragraph Nos. 1 through 10.
12. The Developer will seek a certificate of eligibility from the state historic preservation officer of Defendant DNR and a certificate of eligibility from Defendant DED when the renovation of the Old Post Office is complete.
13. Pursuant to the Secretary's standards that the state historic preservation officer of Defendant DNR must use to determine eligibility, demolition of a building as a part of a rehabilitation project involving multiple buildings is grounds for denial of a certificate of rehabilitation. (See § 253.559, RSMo.; 36 C.F.R. 67.6(b)(5)).
14. The Developer here plans to demolish the Century Building as a part of the rehabilitation project.
15. The GSA has acknowledged that demolition of the Century Building is an adverse effect of the proposed project as defined under the National Historic Preservation Act ("NHPA"). The Century Building is a certified historic structure under the NHPA. The Century Building is listed on the National Register of Historic Places. In addition, the Century Building is not functionally related historically to serve an overall purpose of the Old Post Office.
16. The Developers' demolition of the Century Building would render the rehabilitation project ineligible for Missouri state historic tax credits. (See § 253.559, RSMo.; § 36 C.F.R. 67.6).
WHEREFORE, Plaintiff requests that this Court enter an Order against the Defendants and declare that Defendants DNR and DED shall not issue a certificate of eligible credits to any taxpayers associated with the Old Post Office project because the demolition of the Century Building as a part of the rehabilitation project is a basis for denial of certification pursuant to 36 C.F.R. 67.6 that is warranted under the circumstances.Count II
17. Plaintiff incorporates by reference Paragraph Nos. 1 through 10.
18. Under Missouri state law, non-profit and governmental entities are ineligible for the Missouri historic tax credit. (See §253.557 RSMo.).
19. The MDFB is a non-profit, governmental agency created by the legislature of the State of Missouri to facilitate economic development projects that does not pay state income tax on property that it owns.
20. The MDFB will take title to the Old Post Office during the week of September 20, 2004.
21. The Developers will receive from the MDFB a 99-year lease on the Old Post Office for development pursuant to the terms of the rehabilitation project outlined above.
22. As a part of the rehabilitation project, the Developer plans to seek at least Five Million Dollars in Missouri historic tax credits.
23. As a non-profit, governmental entity, the MDFB is not an eligible taxpayer under the Missouri historic tax credit program. Since the MDFB is not an eligible taxpayer under the program, it has no rights to Missouri historic tax credits that could be transferred to the Developer.
WHEREFORE, Plaintiff requests that this Court enter an Order against the Defendants and declare that Defendants' DNR and DED may not issue a certificate of eligible credits to the MDFB or any other taxpayer pursuant to the Old Post Office rehabilitation project because the MDFB, as the owner of the Old Post Office and the Century Building, is an ineligible taxpayer under §253.557, RSMo. that does not have the right to receive Missouri historic tax credits that could be transferred to or applied for by any taxpayer.

Bond Celebrates OPO Deal

Bond Press Release:

ST. LOUIS, MO –– U.S. Senator Kit Bond today joined Mayor Francis Slay, General Services Administration (GSA) representatives, Governor Holden and other civic leaders to celebrate the transfer of the Old Post Office in downtown St. Louis. This new agreement will ensure the Post Office's recognition as an historic landmark and will bring continued economic development to downtown St. Louis.

"Not only will this redevelopment preserve the Old Post, but it will also provide another needed economic boost for Downtown St. Louis," said Senator Kit Bond. "Revitalizing downtown St. Louis has been a top priority of mine in the U.S. Senate for many years now. I have made it a point to secure Missouri’s fair share of urban federal investment dollars for projects like this one and I will continue to fight for this and other important projects across the state."

Today's event celebrates the transfer of the historic Old Post Office from the GSA to the Missouri Development Finance Board (MDFB). This transfer will allow for the historic preservation of the Old Post Office. This national historic landmark, which first opened in 1884, will provide approximately 155,000 square feet of rentable space. Bond stressed that this transfer will ensure the Old Post Office's place as a symbol of the economic and cultural vitality of downtown St. Louis well into the 21st Century.

MDFB will enter into a long term lease with St. Louis companies, the DESCO Group and DFC group, to implement a $40 million plan to revitalize the Old Post Office and several buildings in the surrounding area. This project will attract new investment in Downtown St. Louis, bringing new businesses and jobs to the area.

Bond secured $2.5 million in stop-gap funding for the Old Post Office in downtown St. Louis and worked with the National Park Service, the City of St. Louis, the State of Missouri, downtown Now!, St. Louis 2004, and local developers, to remove bureaucratic obstacles to re-development. Their combined efforts were instrumental in the goal of ridding urban blight from the heart of downtown St. Louis.

At noon on September 23 in a discussion with Terry Jones and Brady Baybeck, the editors of St. Louis Metromorphosis: Past Trends and Future Directions. This recently released book documents and analyzes economic, social, political and historical aspects of the St. Louis metropolitan area over the last five decades, incorporating the work of twelve scholars from four area universities. How has the region changed, and how does St. Louis’ past frame its future? We’ll also hear responses from Alan Green, St. Louis County Executive’s Office, and Anna Ginsburg, St. Louis City Neighborhood Stabilization Office, about the impact these changes have had on our neighborhoods.

National Black Child Development Institute
What is NBCDI?

Since 1970 The National Black Child Development Institute (NBCDI) a nonprofit organization has provided and supported programs, workshops, and resources for African American children. NBCDI carries out its mission through a national affiliate network. From its headquarters in Washington, D.C., NBCDI provides a national voice on children’s issues, while affiliate chapters provide direct services at the community level. Membership is open to child care professionals, educators, parents, social workers, elected officials and other interested persons. Foci of the organization and its affiliates are: Early Care and Education, Health, Elementary and Secondary Education, Child Welfare, Parenting, and Legislative Awareness.

NBCDI believes every African American child has the right to: 1) Live in good health; 2) Care and protection with the family; 3) Develop a positive self image; and 4) Take pride in their African American heritage and culture.

Through hands-on service and community-outreach programs, NBCDI initiates positive changes for the health, welfare, and educational needs of all African American children. Some examples include: 1) Training professionals and parents to work more effectively with African American children; 2) Tutoring African American youth to achieve academically; 3) Researching issues and producing resources to aid parents and human service providers; and 4) Serving the needs of community leaders dedicated to informing the public about local and national issues affecting African American children.


St. Louis Affiliate

The St. Louis Affiliate was founded in 1972 by Bernice Garner Long. All of our members are volunteers. In addition to carrying out the mission of the national organization, our goal is to be a voice for African American children and children of color in the St. Louis Region. Rack Unveiling

Saturday’s Grand Opening of the new and improved Kingsbury Animal Hospital will benefit stray and abandoned animals in the city of St. Louis. After cutting the ribbon on his new building, Dr. Steve Brammeier will host a silent auction to benefit the Animal House Fund, a program started by Aldermanic President Jim Shrewsbury to replace the city’s dilapidated animal control center. Artica 2004 is a multi-media outdoor participatory arts festival and parade
developed to provide the people of the St. Louis metropolitan area with the
opportunity to come together as a community through creative self-expression
and to develop an international reputation for this area as the gateway to the
arts.

Artists, musicians, dancers, poets, performers and interested citizens are
invited to participate in this unique and multifaceted event by producing high
quality site specific works in any media, to be displayed in a twelve block
area along the Mississippi riverfront.

The Artica festival is an excursion into open fields, vacant warehouses and
industrial sites that were once the home of 19 Mississippian Indian mounds.
This once sacred ground has been industrialized, polluted, abandoned and now
exists as an urban wilderness. The Artica philosophy is one of openness and
rejuvenation. All are welcome to create, participate and celebrate!

The festival grounds will be filled with site-specific works created by
professional artists from the St. Louis metropolitan area. The emphasis will be
on interactive participatory art that takes its inspiration from the river, its
surrounding environment or its history. An overlapping schedule of events
including music, dance, theater, poetry, video, film and performance art will
encourage the audience to move around and experience Artica from different
perspectives. The interactive nature of the event will encourage the audience
to create their own art and become performers themselves.

ADMISSION
Artica is free and open to the public. There is no vending of art or
merchandise. Food and beverages will not be for sale. Bring a picnic with you
and please take your trash when you leave. Wear sturdy shoes and be prepared
for any kind of weather.

Press Release - Rep. Lacy Clay Supports Legislation

End To Ban is 'Utter, Incomprehensible Contradiction'

ST. LOUIS (Monday, September 13, 2004) - The 10-year-old ban on assault
weapons expires at midnight tonight and Members of Congress are appealing to
the President and House of Representatives leadership to consider extending
the ban. United States Representative William Lacy Clay is among those
calling for an extension to the ban, in the hopes of saving lives.
"Today, I join with other Members of Congress in calling for President
Bush and the House Republican Leadership to allow a vote to reauthorize the
ban on assault weapons," Rep. Clay said. "The crime in U.S. cities has
declined significantly over the last 10 years and I strongly believe the
assault weapons ban has been a contributing factor. Major law enforcement
agencies support an effective ban - including 50 police departments in
Missouri -- as well as the families and relatives of victims who have
suffered from gun violence. Assault weapons should be restricted for
military use only.
"Opinion polls overwhelmingly support the assault weapons ban," the
Congressman said. "Congressional leaders are acting to appease one powerful
lobby group at the expense of public safety. Once again, the Bush
Administration is saying one thing and doing another. While trying to remove
assault weapons from the streets of Baghdad, and the rest of Iraq, and
refuses to support a ban on assault weapons from the streets of America.
That is an utter, incomprehensible contradiction. I support two bills to
continue the ban - HR 2038 and HR 3831. Either one will at least keep us
from taking a step back by legalizing assault weapons."
According to the FBI, one in five police officers slain in the line of
duty between 1998-2001 were killed with an assault weapon and 75 percent of
officers killed with a rifle were slain with an assault weapon. Also,
bullets from assault weapons are known to have penetrated body armor worn by
police officers in 17 out of 19 deaths.
"The case for continuing the ban is obvious. The truth is, the outlawing
of assault weapons from the streets of America should be a non-partisan
issue, neither a Democratic nor a Republican issue. Instead, it should be
about protecting the people who protect us. And legalizing the preferred
weapons of cop killers and terrorists is a travesty in our effort to bolster
home security," Rep. Clay said.

BRC looking for Youth Organizer

Youth Organizer Wanted

The Freedom Bound Center is seeking a Part-Time Youth Organizer to help
build a youth presence and intergenerational culture within the Black
Radical Congress project. The BRC is seeking an energetic and articulate Youth
Organizer whose main responsibilities will be to identify issues and projects
that engage the young adult members in the organization. The Youth Organizer
reports to the BRC National Organizer.


Qualifications:

-must be self-motivated and an independent worker
-must have at least two years of organizing youth
-must be able to travel
-must have good writing and speaking skills
-must be computer and internet savvy

Duties and responsibilities
-will establish Youth Caucus and Youth listserv
-will focus on recruitment of members to the BRC from ages 18-25 years old
-will speak at youth-centered events on behalf of the BRC
-will participate in regular conference calls with BRC Coordinating Committee
-will submit bi-weekly monthly work reports

Salary
-will work a maximum of 30 hours per month @ $15 an hour; benefits included

Lead Poisoning Speakers

The Tuesday, September 14, 2004 radio show "Earthworms" will be devoted
to lead poisoning. Hosted by Jean Ponzi, Earthworms airs 7:00 to 8:00 pm on
Tuesdays at KDHX, 88.1 FM in St. Louis. The September 14 guests will be Lee Blount, Jr., MD and Bob Lunsford.

Lee Blount, Jr., MD is a practicing surgeon and a wellness fitness consultant. He has been an activist for 40 years, with concerns about social, cultural and health issues which affect the black community. He helped organize opposition to the medical waste incinerator in the 2nd ward and currently works on issues of lead poisoning and police misconduct. Dr. Blount is a member of the
Organization for Black Struggle, is on the board of St. Louis Health and
Environmental Justice and is on the Health Committee of the NAACP.

Bob Lunsford is a former University of Missouri-Rolla employee exposed to
high level lead ore toxins. He blew the whistle in national news on its cover up.
Both OSHA and MoDNR found in his favor. He co-founded People at Risk (PAR)
to help other lead industry victims. PAR was one of the key groups to bring
national attention to the Herculaneum lead issue. PAR played a major role in the crackdown on Doe Run by providing important investigative data to news
and government agencies. Bob has spent the last six years working on lead
issues. Presently he is coping with damage from lead ore exposure caused by the IBM funded smelter at UMR.

Dr. Blount and Bob Lunsford will also speak at the Great Green Pesto Feast

Blunt gets a pair of Police endorsements

From the Press Release:

Two Missouri law enforcement associations representing nearly 6,000 officers from every region of the state endorsed the gubernatorial candidacy of Matt Blunt last week over his opponent, State Auditor Claire McCaskill.

The St. Louis Police Officers' Association (SLPOA) announced its endorsement of Blunt last Thursday, citing his willingness to work with the organization to enhance the work environment and quality of life for St. Louis police officers.

The Missouri Deputy Sheriffs’ Association (MDSA) announced its endorsement of Blunt on Friday. Blunt’s pledge to seek additional funding to help county sheriffs fight the scourge of methamphetamines coupled with his pledge to seek due process rights and expanded workers’ compensation coverage for law enforcement convinced MDSA members that Blunt would be an effective advocate for law enforcement in Jefferson City.

Philly studies investing in city-wide wireless network

Philadelphia city officials are moving ahead with a plan to turn all 135 square miles of Philadelphia into the world's largest high-speed wireless Internet hot spot. Chief Information Officer Dianah Neff says the city would likely offer the service either for free or at costs far lower than the $35 to $60 a month charged by commercial providers. Estimates to build the system are about $10 million, and would require about $1.5 million per year to maintain it. Mayor Street has named a 17 member committee to study the feasability of the plan and report back to him by this November. City officials anticipate that the plan would help eliminate the digital divide between rich and poor and enhance the city's image as a technology leader.

MO Foundation Health Forum

The Missouri Foundation for Health (MFH) will hold a public health forum in St. Louis on Thursday, September 23 from 6:30 - 8:30 p.m. at the St. Louis Community college Florissant Valley, Student Center's Multi-Purpose Room, 3400 Pershall Road. The College's Campus Life office is co-sponsoring the event.

The purpose of the forum will be to introduce MFH to the community and to receive feedback from attendees on the unmet health care needs in their area. Invitees include individuals and community members from communities in the City of St. Louis and St, Louis County, Franklin, Warren, Jefferson and St. Charles County. Information gathered from the forum will aid the Missouri Foundation for Health in future strategic grantmaking efforts. MFH is the largest health care foundation in the state and is among the largest of its kind in the country.

Lowry to speak at CAM

Glenn Lowry, the Director of The Museum of Modern Art (MoMA), New York, will give a free public lecture on Tuesday, September 14, in the Contemporary's performance space. Lowry became the sixth director of MoMA in 1995. He leads a staff of 550 people and directs an active program of exhibitions, acquisitions, and publications. MoMA is in the midst of the largest building project in its history. Designed by Yoshio Taniguchi, the new museum will open in midtown Manhattan on November 20, 2004, to coincide with its 75th anniversary. The 630,000 square-foot museum will cost $858 million to build. Lowry is currently the Chairman of the Smithsonian Council, and also serves on the advisory council of the Department of Art History and Archaeology at Columbia University. Although the lecture is free, tickets are required for admittance and may be picked-up at the Contemporary's front desk. Seating is limited. Jill Miller heads to Minneapolis

Jill Miller, state conservation organizer for the Sierra Club's national Global Warming and Energy Program, has left her hometown haunts for a while. She recently moved to Minneapolis to join the Sierra Club's environmental voter education campaign team, where she's helping to shine a bright light on the differences between Bush and Kerry's respective voting records on key issues such as air and water pollution and national forest protections. Citizens for Home Rule 990

Interested in seeing the 2003 form 990 for Citizens for Home Rule to get some idea who is paying and who is being paid for the charter reform effort? We are. But we have just been told that they've filed an extension. Their 990 (2003) is now scheduled to be filed by mid-November (after the election, that is) 2004.
