Mitchell Behind Bars

Dustin Mitchell, Mark Rice's campaign manager, was sitting behind bars in St. Louis County today when he spoke to ACC reporter Christine Stroer. Mitchell was arrested for theft, forgery, driving while license was revoked and one other charge (something about a failure to properly affix something). His bail was set at $10,000. Furthermore Stroer determined that the City of St. Louis also wants Mitchell for three other charges.

Not sure it's the same Dustin Mitchell, but there's a warrant for DWI out for him, as of 9/9/05, in the City of St. Louis. This according to the Circuit Clerk's web site. Just search for the name, or case number 059-0005238.

Looks like he might also have some restraining orders and back rent suits against him, too. Assuming, of course, it's the same guy.

The decent thing to do would be to cut this guy some slack, innocent until proven guilty let's not forget, and let him explain this terrible misunderstanding, case of mistaken identity, or whatever in his own writing in the next ACC issue.

Joe brought up an interesting resource. In the City (22nd Judicial Circuit), you can search online for both modern day criminal and civil cases at the Belt of Power's site and on Missouri's Case.net you can search for modern day probate cases. Nearly a hundred years worth of the City circuit's old probate records have been indexed, scanned and available for free at the State Archives site.

In the County (21st Judicial Circuit), the judges do not have to deal with an elected circuit clerk getting in the way and they run things much more efficiently. You can go to their Circuit Court site or Case.net and search for modern day probate cases.

Back to Dustin, has anyone talked with potential candidate Mark Rice, potential since there is to date no campaign committee filed with MEC, to see if Dustin is still running Rice's campaign?

I have left two messages for Mr. Rice, with no response so far.

In all fairness to Mr. Mitchell, I received a prompt, cordial return phone call from him in which he offered to meet me for coffee to discuss the campaign.

Oh, and another thing...Citizens for Mark Rice is a Fictitious Name Registration with Carnahan's office. I was curious about this since no campaign filings are due for awhile, so I made a couple of calls. The reps I spoke with at the Missouri Ethics Commission and Campaign Finance department at the Secretary of State's office determined the filing may have been done this way in order for Rice and Mitchell to open a bank account that wasn't in one, or both, of their names - perfectly legal and seemingly on the up and up, especially if you will be accepting donations.
