Advertising Terms and Conditions

  1. Reservation of Rights: Nextflood Publishing LLC (publisher of the Arch City Chronicle), hereafter referred to as ACC, reserves the right to alter, reject or edit any advertisement(s) at any time. ACC will not knowingly accept any advertisement that encourages discrimination against any individual group on the basis of race, sex, sexual orientation, color, religious creed, national origin or disability. ACC reserves the right to print "Paid Advertisement" on any ad that closely resembles news matter or editorial content.
  2. Rates: All advertising orders are subject to the rates set forth in the current rate card. Ad sales people for the ACC are not authorized to quote any rates or policies which deviate from those found in the Rate Card. ACC reserves the right to revise its advertising rates and/or other conditions set forth in the Rate Card at any time with 30 days notice. In this event, advertisers may amend or cancel their advertising orders on the date that the rate change takes effect.
  3. Deadline: ACC publishes on Tuesday. The deadline for all delivered advertising copy and signed contracts is noon Tuesday one week prior to publication. All copy, photos, artwork, fonts, etc., and payment, if required, must be in the possession of ACC by this time or the space reservation will be automatically canceled, and the advertiser will be billed at the contracted rate.
  4. Cancellations: Advertising canceled after contracts are signed will be billed at the contracted rate.
  5. Payment: Payment is due 15 days from date of advertisement publication. Any outstanding monies owed to ACC after this date will be charged an additional fifteen percent (15%).  Accounts more than 30 overdue are considered delinquent. ACC reserves the right to print the names of delinquent advertisers in the newspaper.
  6. Make Good: In the event that an advertisement contains an error that is clearly the fault of ACC and detracts from the message of the advertisement, a claim for adjustment may be made by only the advertiser; such claims must be filed in writing within 14 days of the publication date of the issue in which the advertisement ran. ACC is not responsible for the print quality of any advertisement that does not meet the standards set forth in the Ad Formats in the Rate Card. ACC does not grant refunds. Balances will be credited to your account for use in a later issue.
  7. Creative Protection: It is the policy of ACC to protect any and all advertisements created by the Arch City Chronicle in that advertisements created by the ACC become the property of Arch City Chronicle and cannot be reproduced or used without the permission of Arch City Chronicle.
  8. Defend and Indemnify: The advertiser and/or the advertising agency agrees to defend and indemnify ACC against any and all liability, loss or expenses arising from any claims for libel, unfair competition, unfair trade practices, infringement of trademarks, copyrights, trade names, patents or proprietary rights or violation of rights of privacy resulting from the publication of an advertisement.
  9. Proof of Publication: Advertisers who would like proof of publication should request tearsheets at the time they place their order. Tearsheets will be mailed within 15 days after publication.
